1. Introduction

Welcome to ShortQuiz.ai ("Service," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and ShortQuiz.ai regarding your use of our website, applications, and services.

By accessing or using ShortQuiz.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Service.

References to "we," "us," or "our" throughout these Terms refer to ShortQuiz.ai.

2. Accounts

To access certain features of our Service, you may need to create an account. When creating an account, you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

We reserve the right to disable any user account at any time if, in our reasonable opinion, you have failed to comply with any provision of these Terms or if activities occur on your account that we determine to be illegal, harmful, or offensive.

3. Children's Usage and COPPA Compliance

ShortQuiz.ai is intended for users of all ages. For children younger than 13, we design our system to minimize the collection of personally identifiable information, in compliance with the Children's Online Privacy Protection Act ("COPPA").

Our practices for younger users include:

We do not require students to submit their full name or contact information
All quizzes are private by default
We do not collect personal information as defined under COPPA without parental consent
The platform does not facilitate direct messaging between users
All content is subject to appropriate filters and reporting tools

Parents/guardians of children under 13 may:

Review, modify, or delete their child's information by contacting support@shortquiz.ai
Create a parent account to manage their child's access
Request that we delete information their children shared with ShortQuiz.ai

We may ask additional questions to verify the identity of parents/guardians before responding to such requests.

4. Subscription and Payment

4.1 Subscription Plans

We offer various subscription plans with different features, limitations, and pricing. Detailed information about each plan is available on our pricing page. You agree that we may change our subscription plans, pricing, and features at any time with or without notice, though we will strive to provide advance notice of significant changes.

The Service is currently in beta. During this period, certain features may be limited, unavailable, or subject to change. We do not guarantee continuous, uninterrupted access to all features of the Service during the beta phase.

4.2 Credit System

Our platform uses a credit system for quiz generation and related features. Credits are allocated based on your subscription plan and refresh on your billing cycle. Unused credits do not roll over to the next billing period unless explicitly stated in your subscription plan.

The number of credits required for specific actions (such as generating quizzes, using premium models, or incorporating images) may vary and is subject to change. We will make reasonable efforts to communicate any significant changes to the credit system.

4.3 Payment

You agree to pay all fees associated with your chosen subscription plan. Payments are processed through third-party payment processors. By providing payment information, you represent and warrant that you are authorized to use the payment method and you authorize us to charge your payment method for the total amount of your subscription.

Subscription fees are billed in advance on a recurring basis according to the billing cycle specified in your subscription plan. All fees are non-refundable except as expressly set forth in these Terms or when required by applicable law.

Prices for subscriptions may be subject to change. We will provide notice of any price change by email or through the Service. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the updated price.

4.4 Subscription Changes and Cancellations

All Paid Subscription Plans must be fully paid prior to each Subscription Period. Once a subscription is paid, it is non-cancelable and non-refundable.

You will be charged before being granted access to your Paid Subscription Plan. Your subscription will automatically renew at the end of your current period unless you cancel.

You may change or cancel your subscription at any time through your account settings or by contacting support@shortquiz.ai. If you cancel your subscription, you may continue to use the Service until the end of your current billing period, after which you will lose access to premium features and your credit allocation will be adjusted according to your new plan.

Downgrading your subscription may result in the loss of access to certain features, content, or credits. We are not responsible for any loss of data or functionality resulting from a subscription change or cancellation.

We do not provide refunds if:

The price for a plan drops after your purchase
We offer subsequent promotional pricing
You're dissatisfied with features or service changes

4.5 Trial Subscriptions

For Trial Subscriptions, we may require payment details to start the Trial. Your Trial will automatically convert to a paid subscription after the trial period ends unless you cancel beforehand.

5. User Content and AI-Generated Content

5.1 Your Content

You retain ownership of any content that you create, upload, submit, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content for the purposes of providing and improving the Service.

You represent and warrant that: (i) you own or have the necessary rights to your User Content and have the right to grant the license described above; and (ii) your User Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person or entity.

5.2 AI-Generated Content

Our Service uses artificial intelligence to generate quizzes and other content based on your input ("AI-Generated Content"). You acknowledge and agree that:

AI-Generated Content may be unpredictable, inaccurate, offensive, or inappropriate, even with proper inputs
You are solely responsible for reviewing and editing all AI-Generated Content before using it
You are responsible for ensuring that the prompts you provide and your use of AI-Generated Content comply with applicable laws and these Terms
We do not claim ownership of AI-Generated Content, but you grant us the same license described in section 5.1 to any AI-Generated Content that you create using our Service
We are not responsible for the consequences of your use or distribution of AI-Generated Content

THE AI FEATURES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES. We expressly disclaim any and all warranties related to the accuracy, reliability, appropriateness, or quality of AI-Generated Content.

5.3 Quiz Content Privacy

All quizzes and content you create on ShortQuiz.ai are private by default and visible only to you. You maintain control over your content and can choose who has access to it.

You are responsible for managing access to your content through the privacy controls we provide. If you choose to share access to your content with others, you remain responsible for ensuring that such sharing complies with these Terms.

5.4 Content Restrictions

You agree not to use our Service to create, upload, transmit, or generate:

Content that violates applicable laws or regulations
Content that infringes or violates the intellectual property rights, privacy rights, or other rights of third parties
Content that is defamatory, obscene, pornographic, abusive, offensive, or harmful
Content that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
Content that is fraudulent, false, misleading, or deceptive
Malware, spyware, or any other malicious code
Content that interferes with or disrupts the integrity or performance of the Service
Content that promotes racism, bigotry, hatred or physical harm
Content that harasses or advocates harassment
Sexually explicit content not related to legitimate educational purposes
Content that exploits minors
Content that solicits personal information from anyone under 18
Information that poses privacy or security risks
Commercial activities without our prior consent
Any illegal content or activities

5.5 Content Monitoring and Removal

We do not proactively monitor or review all content created, uploaded, or generated through our Service. However, we reserve the right (but have no obligation) to review, screen, or monitor any content for any reason, including to ensure compliance with these Terms and applicable law.

We may, in our sole discretion, remove, edit, or disable access to any content that we determine violates these Terms or is otherwise objectionable. We are not obligated to return any content that you have created or stored on the Service if it is removed.

We expressly disclaim any liability for any content provided by users or generated by our AI systems. You acknowledge that by using the Service, you may be exposed to content that you may find offensive, indecent, or objectionable.

6. Copyright Infringement and DMCA Policy

ShortQuiz.ai respects intellectual property rights. If you believe that material on our platform violates your copyright, please notify us at support@shortquiz.ai with:

Your physical/electronic signature
Identification of the copyrighted work claimed to be infringed
Identification of the allegedly infringing material
Your contact information
A statement of your good faith belief that the use is not authorized
A statement that the information is accurate and that you're authorized to act on the copyright owner's behalf

Upon receiving a proper notice, we will promptly remove or disable access to the allegedly infringing material and may terminate accounts of repeat infringers.

7. Intellectual Property

The Service and its original content (excluding User Content and AI-Generated Content), features, and functionality are and will remain the exclusive property of ShortQuiz.ai and its licensors. The Service is protected by copyright, trademark, and other laws of various countries.

Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ShortQuiz.ai. You may not use these marks without our prior written permission.

You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, visual design elements, or concepts without express written permission from ShortQuiz.ai.

8. Data Storage and Export

We store your quizzes, account data, and other content for as long as your account remains active. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security.

You can access, download, and export your content through our platform's export features. We recommend regularly backing up important content to your local storage.

In the event of account termination or service discontinuation, we may retain certain data as required by law or for legitimate business purposes. We will make reasonable efforts to provide you with an opportunity to export your data before termination, but we cannot guarantee this in all circumstances.

9. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. Without limiting the foregoing, you agree not to:

Use the Service in any way that violates any applicable local, national, or international law or regulation
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service
Circumvent, disable, or otherwise interfere with security-related features of the Service
Use any robot, spider, crawler, scraper, or other automated means to access the Service for any purpose
Introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material
Attempt to decompile, reverse engineer, disassemble, or otherwise reduce the Service to human-perceivable form
Access the Service to build a similar or competitive website, product, or service
Use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service

10. Beta Status and Service Availability

ShortQuiz.ai is currently in beta. During this phase, the Service may experience downtime, bugs, or feature limitations as we continue development. We make no guarantees regarding the availability, reliability, functionality, or performance of the Service during the beta period.

We reserve the right to modify, suspend, or discontinue the Service or any part thereof with or without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

We are continuously improving the Service based on user feedback and our development roadmap. Features, functionality, or interfaces may change over time. Your continued use of the Service following any changes indicates your acceptance of those changes.

11. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORTQUIZ.AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SHORTQUIZ.AI MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, OR (v) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SHORTQUIZ.AI OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHORTQUIZ.AI, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, OR SUCCESSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; (iv) ANY AI-GENERATED CONTENT; AND (v) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT WILL SHORTQUIZ.AI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO SHORTQUIZ.AI FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless ShortQuiz.ai, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (i) your use of the Service; (ii) your User Content; (iii) your use of AI-Generated Content; (iv) your violation of these Terms; (v) your violation of any rights of another; or (vi) your conduct in connection with the Service.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If your account is terminated, we may delete your account and any content or data you have provided, though we may retain certain information as required by law or for legitimate business purposes.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

16. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of ShortQuiz.ai resides, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be resolved by good faith negotiations between the parties. If such negotiations do not resolve the dispute within 30 days, both parties agree to submit the dispute to binding arbitration in accordance with the rules of the jurisdiction where the operator resides.

Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Service.

17. General Provisions

Entire Agreement. These Terms constitute the entire agreement between you and ShortQuiz.ai regarding our Service and supersede all prior and contemporaneous written or oral agreements.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of ShortQuiz.ai.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions.

Assignment. You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our written consent. We may assign these Terms at any time without notice.

Force Majeure. ShortQuiz.ai shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government actions, power failures, internet disruptions, or nonperformance of vendors or suppliers.
